Section 8 eviction notices
Fault-based possession for rent arrears and tenancy breaches.
A Section 8 notice is used when a tenant has breached their tenancy agreement — most commonly for rent arrears. Ground 8 (mandatory) applies if the tenant is at least two months in arrears at the time of serving notice and at the court hearing.
When to use Section 8
- Rent arrears (Ground 8, 10, 11)
- Anti-social behaviour
- Property damage
- Other breaches of the tenancy agreement
The Section 8 process
- Assess the grounds and gather evidence
- Prepare and serve Form 3 with correct notice period
- Apply to court if tenant does not leave
- Attend hearing to prove your case
- Arrange bailiff enforcement if needed
Section 8 cases almost always require a court hearing. Our panel of solicitors can advise on grounds, gather evidence, and represent you in court.
